Sheriff Appeal Court Fees (Civil)

The list below shows some fees that are charged for applications and stages of procedure in the Sheriff Appeal Court (Civil). If you require further information, you should contact the Sheriff Appeal Court.

Sheriff Appeal Court Fees

Lodging or opposing a motion or minute

Fee payable from 1st April 2024:

£55

Guidance:
This fee applies to motions and minutes and to oppositions to motions and minutes that are lodged in writing; the fee is payable by the lodging and opposing party.

This fee does not apply to oral motions and oral oppositions to minutes.

This fee does not apply to written motions which accompany a minute.

Fixing a hearing date

Fee payable from 1st April 2024:

 

(a)  under rule  7.14(3)(a)  of  the  Sheriff  Appeal Court Rules (standard appeal procedure)  - £61

(b) under rule 27.2 (accelerated appeal procedure)  - £61

(c) under rule 28.13(3)(a) (application for a new jury trial)  - £61

(d) under   rule   29.2(2)   (appeal  from  summary cause)  - £61

(e) under rule  16.4(1)  of  the  Simple  Procedure Rules(b) (appeal from simple procedure case)  - £61

Guidance: This fee applies to the substantive hearings that arise under the following rules of court:

  • Rule 7.14 (3) (a): an appeal hearing fixed under standard appeal procedure
  • Rule 27.2 an appeal hearing fixed under accelerated appeal procedure
  • Rule 28.13 (3) (a): hearing of an application for a new jury trial
  • Rule 29.2 (2): hearing an appeal from summary cause 
  • Rule 16.4(1): hearing an appeal from simple procedure case

This fee does not apply to non-substantive hearings such as peremptory hearings, procedural hearings or hearings on motions. The fee is payable by the appellant.

Lodging an appeal in a cause other than a summary cause or simple procedure case

Lodging a cross-appeal under rule 7.3 of the Sheriff Appeal Court Rules

: For clarity “cross-appeals” do fall to be charged under this heading. The fee is payable by the lodging party

Lodging an application under section 69 or 71 of the Courts Reform (Scotland) Act 2014

Lodging an application for permission to appeal to the Court of Session under section 113 of the Courts Reform (Scotland) Act 2014

Hearing fee per day or part thereof (bench of 1)

Copying

Fee payable from 1st April 2024:

Copying of -

(a) each document, up to 10 pages - £7

(b) each further page or part thereof - £0.50

(c) each document in electronic form - £7

Searches

Fee payable from 1st April 2024:

Any search of records, or archives -

  • Per 30 minutes or part thereof - £14
  • in addition, correspondence fee where applicable - £14

Accepted Payment Methods

Cheques - Made payable to "The Scottish Courts and Tribunals Service"

Debit Card & Credit Card - Please check which types of card are acceptable with the appropriate court 

Postal Order - Made payable to "The Scottish Courts and Tribunals Service"

Cash - If paying by post it is not advisable to make cash payments
