Case description

[1]    The respondent was convicted at Falkirk Sheriff Court of five charges of violent and sexual conduct towards three complainers. In this appeal against sentence, the Lord Advocate argues that the sentence imposed in respect of charges 1 and 5 was unduly lenient.

[2]    Both charge 1 and charge 5 concerned repeated violent conduct towards his two children including occasions where the respondent seized his young daughter by the throat and restricted her breathing to her injury and danger of life.

[3]     On 7 April 2026, the sheriff imposed a cumulative sentence of 14 months imprisonment in respect of charges 1 and 5. Moreover, the sheriff declined to impose a non-harassment order.

[4]    The appeal against sentence will be heard by the High Court of Justiciary Appeal Court on Friday 14 August 2026 at 10:30am.
