Case description

The appellant was separately convicted of lewd, indecent and libidinous practices and behaviour and repeated rape against two complainers. Prior to trial, he lodged an application to lead evidence that the complainer in the rape charge had previously made a false accusation of sexual assault against another male. The preliminary hearing judge refused the application. The appellant now argues that decision was wrong following the Opinion of the United Kingdom Supreme Court in Daly & Keir v HM Advocate 2026 SC (UKSC) 1.
