Case description

[1] The respondent was convicted of assault to injury, assault, abduction, and attempted murder. Some of the offending was domestically aggravated. The respondent received an extended cumulo sentence of 9 years and 1 month comprising a custodial term of 7 years and 1 month and an extension period of 2 years.

[2] The Crown (prosecution)consider this sentence to be unduly lenient because of the nature of the offending and all of the circumstances.

[3] The respondent was remanded in custody pending trial. However, the first trial diet was discharged due to certain difficulties and he was, thereafter, subject to electronically monitored bail. The Crown contend that the period of time spent on remand and on bail has not been correctly accounted for.

[4] This appeal will be heard by the Criminal Court of Appeal on 7 November 2025.
