Case description

[1] The appellant was convicted at the High Court of Justiciary at Dundee of ten charges including rape and sexual assault of two complainers.

[2] At trial, the Crown led evidence from forensic scientists. Their evidence confirmed that sperm cells matching the appellant’s DNA profile were found on high vaginal swabs taken from one of the complainers. Standing this court’s Opinion in Lord Advocate’s Reference No 1 of 2023 [2023] HCJAC 40, 2023 SLT 1115, the trial judge directed the jury that this evidence was capable of providing standalone corroboration of the Crown case as it related to the charges of rape.

[3] The appellant argues that the trial judge erred in law and that there has been a miscarriage of justice. The appeal will be heard by the High Court of Justiciary Appeal Court on 6 November 2025.
