Electronic motions scheme

Solicitors joining the scheme after 22 September 2015

  1. All participating agents to the scheme must have a centralised charging account with the SCTS Finance Department. This account must be created before joining the scheme. In order to establish an account, please download the information pack and return it directly to the Finance Department. For more information regarding creating an account, please contact the Finance Department at these numbers: 0131 444 3476; 0131 444 3481; 0131 248 1865  or financequeries@scotcourts.gov.uk.
  2. Once a charging account has been created, please contact the All-Scotland Sheriff PI Court by email at national.motions@scotcourts.gov.uk advising that you wish to join the electronic motions scheme. Please also provide the following details:
    • The name of the firm;
    • The full postal address and contact telephone number;
    • The email address which will be used to transact business with the court and other agents (please note that this address must be a generic address and continuously monitored during business hours);
    • Confirmation that a charging account has been set up with the Finance Department.
  3. Following receipt of these details, a test email will be sent from the All-Scotland Sheriff PI Court email address to the email address provided by agents. Confirmation of receipt of this email must be made by reply to the generic email address for the Court.
  4. After confirmation of receipt has been received by the Court, the details of the firm and email address provided will be published in the list of participating agents on the All-Scotland Sheriff PI Court webpage within 24 hours. Once this has been done, motions may be intimated and enrolled in line with the rules of court.

N.B. Emails must only be sent to the stated generic email address for the All-Scotland Sheriff Personal Injury Court. Emails sent to SCTS personal addresses will not be dealt with. If you have been corresponding with a specific member of SCTS staff, please note this either in the subject line or main body of the email.

Party Litigants joining the scheme after 22 September 2015

  1. Please contact the All-Scotland Sheriff PI Court by email at national.motions@scotcourts.gov.uk advising that you wish to join the electronic motions scheme. Please also provide the following details:
    • The name of the individual wishing to join the scheme;
    • The full postal address and contact telephone number;
    • The email address which will be used to transact business with the court and other agents (please note that this address must be continuously monitored during business hours);
    • The full case name and case reference for each action in which you wish to use the electronic motions scheme.
  2. Following receipt of these details, a test email will be sent from the All-Scotland Sheriff PI Court email address to the email address provided. Confirmation of receipt of this email must be made by reply to the generic email address for the Court.
  3. After confirmation of receipt has been received by the Court, the details of the individual and email address provided will be published in the list of participating agents on the All-Scotland Sheriff PI Court webpage within 24 hours. Once this has been done, motions may be intimated and enrolled in line with the rules of court.
  4. Please note that payment for all motions and oppositions must be made at the time of enrolling, either by card payment over the phone or in advance by cheque addressed to the ‘Scottish Courts and Tribunal Service’. If you wish to pay by card, please provide a contact telephone number in your email enrolling your motion or opposition and a member of the court will contact you to process payment.

Opting out the scheme after 22 September 2015

Rule 15A.2.(2) provides for agents who do not have the facilities for transacting motion business by email to opt out of the electronic motions scheme.

In order to do this, please provide a written declaration to this effect to the Sheriff Clerk at Edinburgh Sheriff and Justice of the Peace Court and to every other party in each relevant action. A note will then be made on the All-Scotland Sheriff PI Court webpage to this effect.
