The Accountant of Court has a statutory obligation under the Court of Session Consignation (Scotland) Act 1895 to be the custodian of sums under the following situations:
- Sums held by order of a Court of Session Interlocutor.
- Unclaimed dividends (dissenting shareholders) or unapplied balances in liquidation and administration proceedings.
- Unapplied balances and unclaimed dividends relative to Judicial Factory proceedings.
- Miscellaneous sums held at the discretion of the Accountant of Court.
The Accountant of Court will hold the funds until such times as the rightful party makes a successful claim and uplifts their funds for a period of 7 years. After 7 years any unclaimed funds are held by the Secretary of State under the Scottish Consolidated Fund.
