Updated guidance for claiming expenses in undefended Simple Procedure Actions

The guidance applies to all decisions made on or after 21 May 2025.

The SCTS has issued new guidance for claimants in Simple Procedure claims following an Opinion of the Sheriff Appeal Court (Cabot v Walls published 21 May 2025).

An account of any expenses claimed must be provided to the court before a case will be decided.

A pro forma is available for this purpose for claimants who are not legally represented;

In cases where either,

  • no response form is received by the court by the last date for a response;
  • time to pay is sought by the respondent; or
  • as otherwise directed by the court;
