New Court of Session Rule

The Act of Sederunt (Summary Applications, Statutory Applications and Appeals etc. Rules 1999 and Sheriff Appeal Court Rules Amendment) (Age of Criminal Responsibility (Scotland) Act 2019) 2021 was made by the Court of Session on Thursday 02 December 2021 and laid before the Scottish Parliament on Friday 03 December 2021. It will come into force on Friday 17 December 2021. 

The Act of Sederunt inserts new Chapter 53 in to the Summary Applications, Statutory Applications and Appeals etc Rules 1999, which will provide for applications to be made to the Sheriff Court by Police Scotland under the Age of Criminal Responsibility (Scotland) Act 2019. The Act of Sederunt also inserts Chapter 31 into the Sheriff Appeal Court Rules 2015, which allows for appeals to be made against an order granted at the Sheriff Court.
