In the Fatal Accident Inquiry into the death of
Marko Srsen

The Sheriff having heard evidence determines that,
- In terms of section 6(1)(a) of the Fatal Accidents and Sudden Deaths Inquiry (Scotland) Act 1976, Marko Srsen born 2 December 1969, residing at 11 Kinmylies Cottages, Kinmylies Way, Inverness died on 7 January 2014 at 18.20 hours at the A835 Ullapool to Tore road adjacent to Torgorm near Conon Bridge Rosshire
- In terms of section 6(1)(b) of the Act the cause of death was Traumatic asphyxia caused by compression by a motor vehicle.
- In terms of section 6(1)(c) of the Act the accident and resulting death might have been avoided had the handbrake of the vehicle belonging to the deceased been applied by him or had the vehicle been left in gear by him to prevent its movement.
