N O T I C E

 

 

 

It is a recurring feature of the Outer House that substantive business which proceeds does not conclude within the time allowed.  The continued diets that need to be fixed as a consequence have a knock-on effect on business already programmed for the continuation dates and reduces judicial resources available for new business.  In the last quarter of 2011, almost 25% of substantive business did not conclude at the original diet.

 

Counsel and parties’ representatives are reminded of their responsibilities to assist in the smooth operation of the court.  Hearings should not be fixed on unrealistic estimates.  Doing so leads to serious consequences for judicial availability and the court programme.

 

If parties come to the view that a hearing will take longer than originally fixed, contact should be made at once with the Keeper of the Rolls with a view to fixing a diet of a suitable length.  Parties may face hearings being discharged if they will clearly not finish in the time allowed.
