JUDICIAL STUDIES CONFERENCE: WEEK COMMENCING

31st MAY 2010

 

This gives court users notice of the fact that the High Court of Justiciary and the Court of Session will sit for urgent business only during the week commencing 31st May.  In that week the Lord President has authorised the attendance of Senatros at a conference organised by the Director of Judicial Studies. 

 

On consequence:-

 

          There will be no appeal court sittings during this week for either criminal        or civil appeals

 

          The High Court of Justiciary will sit to deal with bail appeals and cases at       first instance that require to run to a conclusion or would otherwise be time-barred only; and

 

          The Court of Session will sit only to deal with urgent motions, [and to conclude long proof hearings commenced in earlier weeks].

 

Any questions regarding this notice should in the first instance be addressed to the office of the Keeper of the Rolls. 


NOTICE

 

EXPLANATORY NOTE

 

The Lords of Council and Session have made an Act of Sederunt amending the Rules of the Court of Session 1994.

 

Paragraph 2 makes provision whereby procedural provision may be disapplied, and alternative provision substituted, where it is apparent in advance that the provision is unsuitable.

 

Paragraph 3 introduces a new Chapter 12A into the Rules. This regulates the provision of lay support to party litigants in the conduct of proceedings.

 

Paragraph 4 makes amendments to the Rules, including the insertion of a new Chapter 56A, in consequence of the transfer to the UK Supreme Court of the jurisdiction of the House of Lords to hear appeals from cases decided by the Court of Session.

 

Paragraph 5 makes minor amendments to the Rules in consequence of the amendments of admiralty legislation made by schedule 4 to the Bankruptcy and Diligence etc. (Scotland) Act 2007 (asp 3).

 

Paragraph 6 makes a minor amendment to the rule relating to applications for interim payments of damages in personal injuries cases.

 

Paragraph 7 makes amendments to the rules relating to applications for registration of enforcement of a judgment, court settlement or authentic instrument certified as a European Enforcement Order, so as to remove the requirement under rule 62.2 to apply to the court for a certificate of currency conversion. Provision is made instead for such a certificate to be presented to the Keeper of the Registers when making the application.

 

Paragraph 8 makes minor amendments to Chapter 97 (applications for parental orders under the Human Fertilisation and Embryology Act 2008).

 

Paragraph 9 makes new procedural rules for applications in the Court of Session for interdict against unknown persons under sections 12 or 26 of the Energy Act 2008. It inserts a new Chapter 99 of the Court of Session in consequence of the commencement of sections 12 and 26 of the 2008 Act.

Paragraph 10 introduces new rules of procedure relating to causes under the Arbitration (Scotland) Act 2010, by inserting a new Chapter 100 into the Rules and substituting a new Part IX of Chapter 62.

 

The Act of Sederunt comes into force on 7th June 2010, except paragraphs 2 to 9, which come into force on 15th June 2010.
