THE SUPREME COURT IS HOLDING A STAFF DAY ON MONDAY 22nd MARCH 2010.  THERE WILL BE A SKELETON STAFF ON DUTY ON THIS DATE.  THE PATIENCE AND CO-OPERATION OF COURT USERS WITH BUSINESS ON THIS DATE, IN THE SUPREME COURTS, WOULD BE APPRECIATED.

FURTHER INDUSTRIAL ACTION BY COURT STAFF ON WEDNESDAY 24 MARCH 2010

 

Court users should be aware that the Public and Commercial Services Union has called for further industrial action by its members on Wednesday 24 March 2010.  This may result again in reduced numbers of court staff being on duty on these dates.  The continued patience and co-operation of court users with business in the Supreme Courts on this date would be appreciated.  Efforts are being made to provide the best possible service in the circumstances.

The Court will be in recess from Monday 29 March 2010 until Friday 23 April 2010 inclusive.

 

The Offices of Court will be closed on Friday 2 April, Monday 5 April and Monday 19 April 2010.  The Court will sit at 10.00am Tuesday to Friday.

 

Papers due to be lodged on the last three days mentioned will be accepted on the following Tuesdays.

 

SOLICITORS ARE REMINDED THAT THESE COURTS ARE INTENDED ONLY FOR THE DISPOSAL OF URGENT BUSINESS AND ANY MOTION WHICH IS NOT CLASSED AS SUCH WILL BE HELD OVER UNTIL TUESDAY 27 APRIL 2010

EXPLANATORY NOTE

 

 

 

ACT OF SEDERUNT (RULES OF THE COURT OF SESSION AMENDMENT No. 2) (CAUSES IN THE INNER HOUSE) 2010

 

 

The Lords of Council and Session have made an Act of Sederunt amending the Rules of the Court of Session 1994.

 

The Act of Sederunt introduces new rules of procedure for causes in the Inner House. These rules relate to the quorum of the Inner House for dealing with procedural business, as well as the procedures for dealing with reclaiming motions, applications for new trials or to enter jury verdicts and appeals from inferior courts.

 

Consequential amendments are made to the rules on the lodging of documents in Inner House causes and on the issuing of Inner House interlocutors.

 

A reclaiming motion against an interlocutor pronounced before 5th April 2010, an application for a new trial or to enter a jury verdict lodged before 5th April 2010 and an appeal from an inferior court marked before 5th April 2010 will all be governed by the rules of procedure in force prior to that date.

 

The Act of Sederunt comes into force on 5th April 2010.
