INNER HOUSE PROCEDURE

 

APPEALS UNDER STATUTE

 

APPLICATIONS FOR LEAVE TO APPEAL

 

 

 

This notice applies to applications for leave to appeal under Rule of Court 41.2.

 

The practice of the court in recent years has been generally to deal with applications for leave to appeal on the summar roll after hearing arguments on both the application for leave and the merits of the appeal.  That approach was adopted on the basis that it might save court time in the overall consideration of a case.  The court now takes the view that it can deal with applications for leave to appeal, and determine whether there is an arguable case with real prospects of success, without a full hearing of the merits of the appeal.  The Rules of Court, in particular Rules 41.3(2) and 23.6(4), provide for applications for leave to appeal being dealt with on the Single Bills prior to any consideration of the appeal itself, and this notice advises that this will be the practice of the court in future.

 

Accordingly, on the expiry of the period within which answers may be lodged, the applicant may apply by motion for the application to be granted.  This motion will be heard on the Single Bills on a date fixed by the Keeper of the Rolls.  The fixing of the date will normally be done by attendance of agents/parties at the Keeper’s Office.  Any party wishing to respond to the application at the hearing on the Single Bills should lodge answers within the period of notice.

 

The approach set out above will not apply to cases already appointed to the summar roll for hearing.
