A Guide to the Simplified Procedure for Divorce and Dissolution of Civil Partnership in Scotland
Application forms to be used for applications which will be lodged in court on or after 26 February 2007
Application for divorce in the Sheriff Court
Form SPA - Application for divorce (with consent of other party to the marriage) husband and wife having lived apart for at least one year.
Form SPB - Application for divorce husband and wife having lived apart for at least two years.
Form SPC – Application for divorce interim gender recognition certificate issued to one of the parties after the marriage.
Application for dissolution of civil partnership in the Sheriff Court
Form SPD - Application for dissolution of civil partnership (with consent of other civil partner) civil partners having lived apart for at least one yea.
Form SPE - Application for dissolution of civil partnership civil partners having lived apart for at least two years.
Form SPF – Application for dissolution of civil partnership interim gender recognition certificate issued to one of the parties after registration of the civil partnership.
Application for divorce in the Court of Session (Form 49.76A, B or C)
Application for dissolution of civil partnership in the Court of Session (Form 49.80B-A, B-B or B-C)
