The Accountant in Bankruptcy administers personal insolvencies in Scotland. The functions of the Accountant are set out in statute and his main duties are:

  • to generally supervise the process of sequestrations.
  • to ensure that Interim and Permanent Trustees properly carry out their functions according to law.
  • to carry out the functions of commissioners where none are or may be elected.
  • to investigate complaints and report offences.

In 1993 a change in the law required the Accountant to act as Interim and Permanent Trustee in sequestrations where no insolvency practitioner is nominated, elected or appointed to those offices.
