Lord Bannatyne was appointed a Judge of the Supreme Courts in November 2008, and succeeds Lord Carloway as the senator member of the Board. Lord Carloway is a member of the Board by virtue of his appointment as Lord Justice Clerk.

Sheriff McCulloch is a sheriff in Kirkcaldy. He was appointed to fill the vacancy created when Sheriff Derek Pyle was appointed as the Sheriff Principal of Grampian, Highland and Islands earlier this year.
